Supernova Vs Supernova Show
A Southern California rock band called Supernova has filed a complaint against Mark Burnett’s CBS reality show “Rock Star: Supernova,” saying it had the name first. They has filed a complaint alleging unfair competition and trademark infringement against Mark Burnett Productions, CBS and the other minds behind the competition show Rock Star: Supernova. Lee, former Guns N’ Roses guitarist Gilby Clarke and former Metallica bassist Jason Newsted are using the on-camera opportunity to choose the next hot, yet appropriately surly, young thing to front their new band.
“Our clients believe they have the superior right on the mark Supernova,” said the band’s attorney, John Mizhir, adding the band “has a long-standing common-law trademark right to the mark.”
Supernova wants Rock Star’s producers to “publish clarifying statements” that the show is not affiliated with the band. It is also asking the court to order that all “labels, signs, prints, packages, wrappers, containers, advertisements, electronic media and other materials bearing the Supernova mark” be destroyed.
The Supernova group first performed under the name in 1991, according to the lawsuit, and released several singles and three full-length albums under the name.
The CBS show first aired July 5. It follows 15 contestants who aspire to be the lead singer of a new rock band that includes former Motley Crue drummer Tommy Lee and former Guns N’ Roses guitarist Gilby Clarke.
